Please read these Terms of Service ("Terms") carefully before using the website chemobtain.com (the "Site") and any related services (together, the "Service") operated by Eigenvector, MB ("ChemObtain", "we", "us", or "our").

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

1. About ChemObtain

ChemObtain is an online directory that connects buyers and researchers with chemical suppliers worldwide. The Service allows:

Visitors and buyers to search for chemical substances by CAS number or name, view supplier listings, and access chemical reference data.
Suppliers to create company profiles, list products, and make their contact information available to buyers.

ChemObtain is a directory and information platform only. We are not a party to any transaction between buyers and suppliers. We do not buy, sell, manufacture, store, ship, or take custody of any chemical substances.

2. Eligibility

You must be at least 18 years of age to create an account or use the Service. By creating an account, you represent and warrant that:

You are at least 18 years old.
You have the legal capacity and authority to enter into these Terms.
If registering on behalf of a company or other legal entity, you have authority to bind that entity to these Terms.
You will use the Service in compliance with all applicable laws and regulations.

We reserve the right to refuse access to the Service to any person or entity at our sole discretion.

3. User Accounts

3.1 Registration

To access certain features of the Service (such as saving chemicals or managing a supplier profile), you must create an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain and promptly update your account information to keep it accurate.
Keep your password confidential and not share it with any third party.

You are solely responsible for all activity that occurs under your account, whether or not you authorised it.

3.2 Account termination

You may delete your account at any time from your account settings. We reserve the right to suspend or terminate your account, with or without notice, if we believe you have violated these Terms, provided false information, engaged in fraudulent or illegal activity, or if required by law.

4. Buyer Conduct

As a buyer using ChemObtain to find chemical suppliers, you acknowledge and agree that:

The chemical information displayed on the Site (properties, safety data, identifiers) is provided for informational and reference purposes only. It may not be complete, current, or accurate for your specific use case. You are solely responsible for independently verifying all information before making purchasing or scientific decisions.
All products shown on the Site are intended solely for non-medical, non-clinical uses such as industrial applications and scientific research. They must not be used for clinical diagnosis or treatment in humans or animals.
You are solely responsible for ensuring you hold all required licences, permits, and qualifications applicable to your jurisdiction before purchasing or working with any chemical substance, particularly hazardous or controlled materials.
ChemObtain does not verify the accuracy, legality, safety compliance, or quality of supplier listings. You are responsible for conducting your own due diligence on any supplier before entering into a transaction.

5. Supplier Listings

5.1 Supplier obligations

If you register as a supplier and create a profile or product listings on ChemObtain, you represent, warrant, and agree that:

All information in your profile and listings (company name, address, contact details, product descriptions, pricing, certifications) is accurate, complete, and not misleading.
You own or have all necessary rights, licences, and authorisations to offer for sale and supply the products listed.
Your products and business practices comply with all applicable laws and regulations in your jurisdiction and in the jurisdictions where you supply goods.
You hold all required licences, registrations, permits, and certifications applicable to the chemicals and materials you list.
You will promptly update your listings if any information becomes inaccurate or outdated.

5.2 Prohibited listings

You must not list any product or content that:

Is illegal to manufacture, possess, sell, or supply under applicable law.
Is a controlled substance or precursor chemical listed under any international treaty (e.g. the UN Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances) without appropriate authorisation.
Is falsely described, counterfeited, or misrepresented as to its origin, composition, or properties.
Requires a specific end-user licence that you cannot provide.

We reserve the right to remove any listing at our sole discretion and to terminate supplier accounts that violate these rules.

5.3 No endorsement

The appearance of a supplier or product on ChemObtain does not constitute our endorsement, recommendation, verification, or approval of that supplier, product, or any claim made in a listing.

6. Prohibited Conduct

You agree not to use the Service to:

Violate any applicable local, national, or international law or regulation.
Submit false, misleading, or fraudulent information.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Harvest, scrape, or systematically collect data from the Site without our prior written consent.
Use automated tools (bots, crawlers, scrapers) to access or index the Site in a manner that exceeds reasonable use or damages the Site's performance.
Transmit any malicious code, viruses, or harmful software.
Attempt to gain unauthorised access to any part of the Service, our servers, or any other system connected to the Service.
Interfere with or disrupt the integrity or performance of the Service.
Engage in any conduct that restricts or inhibits any person from using or enjoying the Service.
Circumvent any security, rate-limiting, or access controls we implement.

7. Intellectual Property

7.1 Our content

All content on the Site that is original to ChemObtain — including but not limited to the Site design, logos, software, source code, editorial articles, and compilation of directory data — is owned by Eigenvector, MB or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You may view, browse, and use the Site for its intended purpose (finding suppliers and chemical information) but may not copy, reproduce, distribute, modify, publicly display, or create derivative works from our content without our prior written permission.

7.2 Chemical data

CAS numbers are assigned by the Chemical Abstracts Service (CAS), a division of the American Chemical Society, and are not owned by ChemObtain. Chemical property data, safety information, and identifiers are compiled from publicly available sources. We make no proprietary claim to these data points.

7.3 Supplier-submitted content

By submitting a supplier profile, product listings, descriptions, images, or other content to ChemObtain ("User Content"), you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to display, reproduce, and distribute that User Content on the Site and in related promotional materials for the purpose of operating the Service.

You represent and warrant that you own or have the rights to all User Content you submit, and that it does not infringe any third party's intellectual property rights.

8. Chemical Safety Disclaimer

Important: ChemObtain is an information directory, not a regulated chemicals authority.

Chemical data displayed on the Site (including safety data, GHS classifications, hazard statements, and physical properties) is sourced from publicly available databases and is provided for general informational purposes only. It may be incomplete, out of date, or not applicable to your specific product grade or use case.
Always consult the current Safety Data Sheet (SDS) provided directly by the supplier or manufacturer before handling any chemical.
Comply with all applicable occupational health and safety regulations, environmental laws, and chemical control regulations in your jurisdiction.
We strongly advise engaging qualified safety professionals before purchasing or handling any hazardous chemical substance.

ChemObtain assumes no liability for any harm, injury, loss, or damage arising from reliance on chemical data displayed on the Site.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

Warranties that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

ChemObtain shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, business interruption, or loss of goodwill, even if advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service — whether in contract, tort (including negligence), or otherwise — shall not exceed the greater of (a) the total amount you have paid to ChemObtain in the twelve (12) months preceding the claim, or (b) EUR 50.

Nothing in these Terms limits liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

11. Indemnification

You agree to indemnify, defend, and hold harmless Eigenvector, MB, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Your use of the Service.
Your User Content.
Your violation of these Terms.
Your violation of any applicable law or regulation.
Any transaction or dispute between you and a supplier or buyer.

12. Third-Party Links and Services

The Site may contain links to third-party websites (including supplier websites and external references). These links are provided for your convenience only. We have no control over the content, accuracy, or privacy practices of third-party websites and accept no responsibility for them. Linking to a third-party website does not imply endorsement.

13. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service — including features, pricing, or access levels — at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

14. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Kaunas, Lithuania, unless you are a consumer in the EU/EEA with a right to bring proceedings in the courts of your country of habitual residence.

If you are a consumer in the European Union, you also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where required, notify you by email or a prominent notice on the Site. Your continued use of the Service after the updated Terms are posted constitutes your acceptance of the changes.

If you do not agree to the updated Terms, you must stop using the Service.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or notices published on the Site, constitute the entire agreement between you and ChemObtain regarding the Service and supersede all prior agreements, representations, and understandings.
